Postie bike just crashed in to me

I was riding my bike on the footpath and a known corner was coming up so I slowed as usual, when a postie comes round the corner not even looking so I stop and shouted at him... bang farker hits me.

Handle bars when in to my leg... massive bruise... bent rim (DT Swiss $$$), scratches.

What should I do?

If YES: Run away smartly before you get arrested
If NO: Yell at the rider & call the insurance leeches then yell again then have
a beer or thrice.

I would ask for a new bike or at least fix it. And expect an apology -however I am sure he would have been (which you did not say!) and leave it at that.
We all make mistakes and everyone is under the pump these day's.

If your expecting a payout your kidding yourself. You have to remember he is like the rest of us trying to earn some coin. Any action you take or others saying sue sue sue is just plain Un-Australian.

And the big bad bruises and scratches will heal. He looses his job - tax payers now have to support him - his wife leaves him - his children are raised in a broken family - the saga now continues.

Do the right thing and don't expect $$$$$$.

Oh and also sorry to hear, sounds like your ok though and that's the main thing.

The bruise hurts motherfarkers! It's getting more and more painful.
But I just want my bike fixed... apart from the rim there's a dent in the frame.

And my elbow hurts now too.

Riding on the road is suicide... and I wasn't riding I was stopped.

Austraila post are self insured, I have delt with them in the past on behalf of a customer and it's safe to say unless you are prepaired to use the courts your screwed.

I would at least make an Incident Report to Aust Post and perhaps the Police - not so much to seek any $$$ compensation, but to cover yourself if you end up needing medical treatment...

NB: I have had cycling accidents where I thought I had a bad bruise/spain and ended up having X-rays a week or so later when the pain had not really reduced to find broken (not fractured) bones.

I was stopped... the handlebars went in to the leg that was supporting me (stopped).
If I had been riding on the road, I would already be dead.

My average cycling speed: 15kmh
Average car speed: 70kmh
Average pedestrian speed: 5kmh

Car density on sydney roads for 100m: 20 cars + trucks + buses
People density on footpath for 100m: 0.08 people

Your chances of being hit on the road vs footpath are like... hmm... virtually guaranteed given the speed differential.

Sure if you can ride at 60kmh you'll be better off... otherwise your RIP.

PS: My hip hurts now too ... just imagine what a car would feel like!

I have been on workers comp now for 9 weeks after hurting my back at work. Also got fired 2 weeks after doing my back.

I had to wait 8 weeks before I got any money because so many people think they can play the system. The investigation is tedious.

People have no idea when you have a genuine injury how much you have to do to prove it. This has been the hardest thing in my whole life. Try paying the bills when you are used to a 1k week income and BAM no more money, no job, future jobs now down the drain. Complete lifestyle change.

If your joking ha ha if not that's just sad and poor Australia.

What if I'm riding with my 5 year old? I take him on the road too?
What if we were coming around the same corner when the postie came?

I saw a guy with one of those "hitchhiker" things on the back of his bike this morning. Those bikes for kids you attach to the back of your bike. His girl was on the back. Maybe 6 years old.

...on the road, in Melbourne CBD, peak hour traffic.

By everyone saying that you were not allowed to be on the path..I take it, it wasn't a shared path?

A "Shared path" allows bikes and pedestrians. You can check with the council on this. Only a few years back we had the council spray markings on pretty much every footpath in town to mark them as "shared".

Hang on fellas-

The postie ran into a stationary bicycle, damaged the bicycle and injured the owner.
It shouldnt matter where it happened. In most states, road rules apply on road reserves, you can even be charged with traffic offences while driving on private property.
The bike was stopped- and the bikes owner had time to shout a warning. he was obviously paying attention to what was going on.just like the law requires us.
Postie obviously wasnt watching where he was going or paying attention to his work area.against traffic laws, and most likely the OHS laws that Aust. Post and its employees are required by law to comply with.

The way I see it, the postie is clearly in the wrong.

Why should he not be held responsible for his actions?
If I was to drive my car/ ride a motorcycle into another stationary vehicle- damaging it and causing injury, you can guarantee that I would (at least) be charged with careless driving/ riding, possibly dangerous or reckless driving causing injury, If I was to reverse out of my driveway and run over a little kid, or pedestrian, or bike rider I would be at fault without a doubt.

First thing I would be doing is reporting the incident to the police and insisting that they follow it up.
Then down to the docs for some xrays to make sure nothings broken or nothing worse is developing from the accident (blood clots?)

In western australia- when you go to the doctor, they want to know if its workers comp (boss + insurance company pays), motor vehicle(Motor vehicle insurance trust pays as far as I know) or a regular visit so its you, your private health insurance and medicare that foot the bill.

not saying go and chase over the top compo, just cover yourself.

I would expect Aust.Post to return the bike to its former glory and your medical costs should be covered by the compulsory third party cover everyone has on thier rego.(Aust.Post motorcycles are regoed just like ours as far as I know)

Hang on Stephen , I was being chased by a dog not under control . We posties are entitled to a safe work place free off marauding dogs and flysurfers on pushbikes !!!!
