There are a couple of things to be concerned about. The flags is one. The other are some buoys which indicate a no boating zone. Generally the authorities will turn a blind eye if you get out and stay out past the buoys which are about a hundred or two hundred metres out. Whatever you do, stay away from swimmers and watch the water for swimmers, some people swim from pier to pier a couple of hundred meters out.

That spot is gusty if there is too much westerly in the wind and it does happen regularly in summer. If its too westerly, head to st kilda, brighton or hampton if you're looking for a quieter spot.
Other quieter spots to look at here, same rules apply. I.e. if its busy with swimmers, get out and stay far away from shore. They're not officially kiting spots but the authorities turn a blind eye as long as you don't do stupid things. At the spot near the tasmanian ferry (the one on the right), don't get too close to the ferry, particularly if its refuelling.
There are also some really good spots if you're prepared to travel for an hour or so.
