In NSW this was recently amended from needing to wear a PFD 2 or 3 at all times, to what it used to be, which is "not required unless kiting alone and more than 400M offshore".

Dammit just a matter of time before the nanny state spread its tentacles to the wild west. Got a mate in NSW who now has to wear a PFD while taking his inflatable dinghy from the beach to his yacht 100m away but doesnt need one if he swims out. Such is "progress"

Peeps,

you need to read the small print, literally.

The reference is in relation to offshore kite and windsurfers
It is a requirement that lifejackets are worn when operating more than 400 metres offshore in unprotected waters. This lifejacket can be a level 50S or higher.

Not sure how often you're 400m offshore, however, if you want the specific details go here:

dude im offshore 400m + everytime i kite. Be interesting to see what happens here in margs now. Local cop will be in a bind trying to enforce this latest piece of beaurocratic idiocy
